The purpose of this Information on the processing of personal data is to inform you clearly how your personal data collected by the data controller (as defined below) is handled as required by law, including the provisions of the General Data Protection Regulation of the European Union („General Data Protection Regulation – GDPR“). Your personal data will be processed by the data controller in accordance with the conditions stated here.

The collected personal data will be processed by the data controller.

This Information on the processing of personal data concerns 

  1. people we help find jobs and recipients of our career services such as outplacement.
  2. Users of Dilibees, s.r.o. and the aforementioned websites and applications (hereinafter referred to as „sites“), 
  3. Representatives of our business partners and clients
  4. Persons whose personal data we use for our marketing activities a 
  5. People who are recommended to us by people who are interested in employment mediation. This Information on the processing of personal data does not apply to employees who work directly for Dilibees, s.r.o. or for another company from the Dilibees, s.r.o. group

This Privacy Notice also describes the categories of personal data we collect about you, how we use, process and protect it, how long we keep it, with whom we share it, where we transfer it and the rights you have as an individual in relation to it that we use your personal data. We also tell you how you can contact us about our privacy practices and how you can exercise your rights. Our privacy practices may vary from country to country in which we operate to reflect local practices and legal requirements.

Personal information we collect

We may collect personal data about you in various ways, for example through our website, social media channels or other internet applications; at our events; by telephone and fax; in personal dealings in connection with employment mediation; or in connection with interactions with our business partners and clients. We may collect selected personal data depending on the nature of the relationship with you, in particular (as permitted by local law):

  • contact information (such as name, postal address, email address and telephone number);
  • username and password if you register on our site;
  • information you provide about your friends or other people you would like us to contact. (The Administrator assumes that these persons have given prior consent to this communication); and
  • other information you provide to us, e.g. in surveys or through the „Contact Us“ icon on our site.

If you are a job seeker, apply for a position, or create an account to apply for a position, we may collect the following categories of personal information (as permitted by local law):

  • professional history and educational history;
  • language skills and other job-related abilities;
  • personal identification number;
  • birthdate;
  • sex;
  • bank account information;
  • citizenship and work permit status;
  • tax related information;
  • information provided by third parties as a reference;
  • information contained in your resume or CV;
  • information you provide regarding your career interests and other information about your qualifications for employment; and
  • information regarding your employment with our company or with our client,
  • and if permitted or required by law:
  • information about your disability and health condition;
  • drug test results, criminal record information, and other background checks.

In addition, we may collect information you provide us about other individuals, such as emergency contact information.

How we use the personal information we collect

The Administrator uses the collected data for the following purposes (as permitted by local law):

  • employment mediation;
  • creating and managing online accounts
  • managing relationships with our clients and business partners;
  • in accordance with the data controller’s notice on cookies and advertising ( which is incorporated herein by reference ), sending promotional materials, notifications about available positions and other communications;
  • informing you of and allowing you to participate in special events, programs, offers, surveys, contests and market research;
  • answers to your questions and requests;
  • operating, evaluating and improving our business (including developing, improving, analyzing and improving our services; managing our communications; performing data analysis; and maintaining accounting, performing audits and other internal functions);
  • protection against, detection and prevention of fraud and other illegal activities;
  • handling complaints and defending legal claims; and
  • to comply with and enforce applicable legal requirements, applicable industry standards, contractual obligations and our policies.

All processing will be carried out on the basis of appropriate legal reasons, which in particular include:

  • Your consent or express consent if required by applicable law (e.g. processing of your personal data for our marketing activities or continuous placement of employment);
  • necessary for the legitimate interest of the data controller, as described in more detail below (e.g. making the website available to the user in order to provide him with the services offered).

In addition to the above activities, if you create an account to apply for a position, as permitted by local law, we will use your personal information as described above for the following purposes:

  • to provide you with employment opportunities and work;
  • to provide you with human resources services;
  • to provide you with other services such as training, career guidance and career change services;
  • assessment of whether you are suitable as a job applicant and the suitability of your qualifications for the given position; and
  • perform data analysis, such as (i) analyzing our job applicant database; (ii) assessment of individual performance and competence, including assessment of work skills; (iii) identification of skill gaps; (iv) using information to connect individuals with potential opportunities, and (v) analyzing trends related to recruitment practices.

If we want to use this information in other ways as well, we will notify you in advance.

Legitimate interest

The data administrator may process your personal data for a certain legitimate business purpose, which may be:

  • improving and personalizing our services and communications for the benefit of our clients, job seekers;
  • fraud detection and prevention;
  • increasing the security of our network and our information systems;
  • better understanding of how people interact with our websites;
  • direct marketing;
  • sending you communications that we think may be of interest to you;
  • determining the effectiveness of promotional campaigns and advertising;
  • the exercise of our rights towards you or our clients and business partners;
  • fulfillment of contractual obligations towards our clients or business partners.

How long we keep the personal data we collect

In our systems, we store the collected personal data in such a way as to enable your identification for no longer than is necessary in view of the purpose for which your personal data was collected or for which this data is processed.

We set this specific time with regard to:

  • the need to store stored collected personal data for the purpose of offering and providing the services requested by you;
  • safeguarding the data controller’s legitimate interest as described above;
  • the existence of specific legal or contractual obligations that make processing and related retention necessary for a specific period of time;
 

Personal information we share

We do not disclose the personal data we collect about you, except as described in this Information on the processing of personal data or in separate notices provided in connection with specific activities. We may share your personal information with our business partners who provide services on our behalf based on our instructions. We do not grant these business partners permission to use or disclose personal information except as necessary to provide services for our benefit or to comply with legal requirements. We may also share your personal information with (i) our subsidiaries and affiliates; (ii) if you are a job seeker, with clients who may have job opportunities available or be interested in placing our job seekers, or with other persons with whom we cooperate, such as external consultants and translators, to find you a job or help you secure entry to the labor market in the Czech Republic; and (iv) with legal and tax advisors, if necessary to fulfill our legal obligations or defend legal claims.

In addition, we may disclose personal information we collect about you (i) if we are required to do so by law or legal process; (ii) to law enforcement or other governmental authorities based on a lawful disclosure request; and (iii) if we believe that disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected fraudulent or illegal activity or actual fraudulent or illegal conduct. We also reserve the right to transfer the personal information we hold about you in the event that we sell or transfer all or part of our business or all or part of our assets (including in the event of a reorganization, dissolution or liquidation).

Transfer of personal data to other countries

We may transfer the personal data we collect about you to countries other than the country in which the personal data was originally collected. These countries may not have the same personal data protection laws as the country in which you originally provided the personal data. If we transfer your personal data to other countries, we will protect it as described in this Privacy Notice and such transfers of personal data will comply with applicable laws.

The countries to which we may transfer your personal data that we collect about you may be located in:

  • in the European Union
  • outside the European Union

  • Right of access: You have the right of access to personal data concerning you in order to verify whether your personal data is processed in accordance with legal regulations.
  • Right to rectification: You have the right to request the rectification of any incorrect or incomplete data held about you in order to protect the accuracy of this information and make it suitable for processing.
  • Right to erasure: You have the right to request that the data controller erase your personal data and no longer process this data.
  • Right to restriction of processing: You have the right to request that the data controller restricts the processing of your personal data.
  • Right to data portability: You have the right to request data portability; this means that you can receive the originally provided personal data in a structured and commonly used format or that you can request the transfer of the data to another data controller.
  • The right to object: You have the right to object at any time to the processing of your personal data for a number of reasons listed in the GDPR, without having to justify your decision.
  • The right not to be the subject of an automated individual decision: You have the right not to be the subject of a decision based solely on automated processing, including profiling, if these profiling procedures have legal effects for you or significantly affect you in a similar way.
  • The right to file a complaint with a supervisory authority: You have the right to file a complaint with a supervisory authority, in particular in the EU member state of your habitual residence, place of employment or the place where the alleged violation occurred, if you believe that the processing of your personal data violates the GDPR.
 

Whenever the processing is based on your consent, as stipulated in Article 7 of the GDPR, you can withdraw this consent at any time.
